Invictus Identity and Accreditation Card
This Invictus Identity and Accreditation Card (this “IIAC”) remains the property of the Vancouver Whistler Games Corporation (“IG25”) and is non-transferable. By accepting this IIAC I acknowledge and agree that this IIAC and all rights under it can be revoked, with immediate effect, at any time at IG25’s sole discretion.
By using this IIAC, I:
- grant IG25 an irrevocable, perpetual, transferable, sub-licensable, royalty-free, worldwide licence to use my name, image and likeness collected during the Invictus Games Vancouver Whistler 2025 (the “2025 Games”) to market, promote and commercialize the 2025 Games and future Invictus Games;
- agree that my personal information may be collected, used and disclosed by IG25 as set out in its privacy policy on its website at: https://invictusgames2025.ca/privacy/. I understand I can review the privacy policy at any time and may contact the Privacy Officer, Jeff Garrad ([email protected]) with any questions regarding the collection, use and disclosure of my personal information;
- agree that all photographs, audio and moving images I take or collect at the 2025 Games shall be used solely by me for personal and non-commercial purposes, unless prior written consent is obtained from IG25. I agree that I will not create, transmit, display or distribute, livestreams of any portion of the 2025 Games;
- agree to abide by all venue and facility rules and policies and any additional IG25 rules and policies that are shared with me from time to time and acknowledge that IG25 and any venue or facility may make changes to its rules and policies at any time without prior notice; and
- confirm that I fulfill the qualifications and conditions to be issued this IIAC; and
I ACKNOWLEDGE AND AGREE, ON BEHALF OF MYSELF, MY HEIRS, ADMINISTRATORS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN AS FOLLOWS:
1. I HAVE ASSUMED ALL RISKS associated with my use of the IIAC and attendance at any venue and facility accessed through my use of the IIAC, whether arising from my own actions or inaction, my own negligence, the actions or inaction of others, the negligence of others, or the actions or inactions, negligence, and / or omissions of the Released Parties (as defined below), and I hereby voluntarily and knowingly assume all such risks and responsibility for any damages, liabilities, losses, or expenses that I incur as a result; and
2. I HEREBY FOREVER RELEASE, DISCHARGE AND WAIVE ALL CLAIMS that I have, or may in the future have against any person(s), entities or organization(s) associated in any way with IG25, the Invictus Foundation, the Invictus Games and their sponsors, promoters, owners and lessees of any event facilities or venues, sanctioning bodies, associations, or any subdivision thereof, advertisers, vehicle owners, other participants, rescue personnel, event inspectors, and consultants, and each of their respective directors, officers, employees, contractors, agent and representatives (all of whom are collectively referred to as the “Released Parties”) from any and all liability for any loss, damage, injury or expense that I may suffer as a result of my use of or my presence at the event facilities or venues in any capacity, due to any cause whatsoever, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1996, C. 337, ON THE PART OF THE RELEASED PARTIES.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I UNDERSTAND THAT BY ACCEPTING AND USING THE IIAC THAT I HAVE AGREED TO THE FOREGOING AND THAT I HAVE WAIVED CERTAIN SUBSTANTIAL LEGAL RIGHTS WHICH I AND MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND PERSONAL REPRESENTATIVES MAY HAVE AGAINST THE RELEASED PARTIES.
